O ministro Humberto Martins, do STJ (Superior Tribunal de Justiça), negou habeas corpus ao ex-presidente Lula, informou a assessoria de imprensa da corte. Na semana passada, Lula foi condenado por lavagem de dinheiro e corrupção passiva em segunda instância, pelo TRF-4 (Tribunal Regional Federal da 4ª Região).
Nesta terça-feira (30),a defesa recorreu ao STJ com um pedido de habeas Corpus preventivo para afastar a possibilidade de antecipação de cumprimento da pena de 12 anos e 1 mês de prisão em regime fechado. A informação foi antecipada pela colunista da Folha de S.Paulo Mônica Bergamo.
Na prática, a defesa de Lula pediu uma espécie de “superliminar” para anular a decisão do TRF-4.
Pela Lei da Ficha Limpa, o petista fica inelegível e não pode concorrer na eleição deste ano. Mas os advogados argumentam que a inelegibilidade pode ser afastada com base no artigo 26-C da Lei Complementar nº 64/1990, que determina: “O órgão colegiado do tribunal ao qual couber a apreciação do recurso contra as decisões colegiadas () poderá, em caráter cautelar, suspender a inelegibilidade sempre que existir plausibilidade da pretensão recursal e desde que a providência tenha sido expressamente requerida, sob pena de preclusão, por ocasião da interposição do recurso”.
Depois da condenação pelo TRF-4, o PT lançou Lula para presidente na eleição deste ano.
No documento, a defesa afirma que, se Lula ficar fora da corrida eleitoral, a democracia brasileira sofrerá “prejuízo irreversível”.
“A privação de sua liberdade no período de campanha (ou pré-campanha) eleitoral, consideradas as credenciais acima referidas, configurar-se-ia em um prejuízo irreversível ao exercício da democracia no país – que pressupõe o debate de ideias muitas vezes antagônicas entre si”, diz o texto.
