O governador de Pernambuco Paulo Câmara sancionou a Lei nº 16.276/2017, publicada nesta quinta-feira (28) no Diário Oficial, que tem como objetivo formalizar os pequenos produtores de queijo artesanal dos tipos coalho e manteiga, aperfeiçoando o sistema fiscal e sanitário do processo produtivo. A medida atrela a dispensa de ICMS, benefício que o setor já possui, a um crédito presumido ao adquirente e só validado por meio da emissão da Nota Fiscal Avulsa Eletrônica (NFA-e).
O documento deverá ser emitido por meio do módulo de “queijo artesanal”, que será implantado no portal da Secretaria da Fazenda de Pernambuco (Sefaz-PE) em janeiro de 2018, em conjunto com o registro no Sistema de Inspeção Estadual (SIE) fornecido pela Agência de Defesa e Fiscalização Agropecuária de Pernambuco (Adagro). Na ocasião, também será publicado um decreto regulamentando o benefício.
“A nova legislação trará maior segurança para os fabricantes de queijo artesanal, evitando a concorrência desleal por parte de empresas de grande porte e atestando a qualidade e origem dos produtos adquiridos pelo consumidor”, afirma o governador Paulo Câmara.
O crédito presumido permite que o adquirente dos queijos artesanais diminua o valor do ICMS recolhido quando revender o produto, representando um incentivo para que os atacadistas e revendedores comprem essas mercadorias para comercializarem, uma medida altamente benéfica ao mercado local. O contribuinte que deseja usufruir do benefício deverá estar regular com a fazenda estadual e ter como atividade principal a fabricação de laticínios.
