Em julgamento realizado hoje, o TRE-BA negou o deferimento do registro de candidatura a deputado federal de Isaac Carvalho. No entanto, a decisão não impede que o ex-prefeito de Juazeiro mantenha sua campanha. Ele recorrerá ao TSE.
Os advogados de Isaac citam artigo 16-A da Lei 9.504/97, que assegura: “O candidato cujo registro esteja sub júdice poderá efetuar todos os atos relativos à campanha eleitoral, inclusive utilizar o horário eleitoral gratuito no rádio e na televisão e ter seu nome mantido na urna eletrônica enquanto estiver sob essa condição, ficando a validade dos votos a ele atribuídos condicionada ao deferimento de seu registro por instância superior”.
Várias decisões do Tribunal Superior Eleitoral têm garantido a políticos o direito a participar do pleito, em situação semelhante. “Temos absoluta convicção da lisura dos nossos atos. O próprio tribunal reconhece que não houve dano ao erário. No TSE, iremos em busca do direito legítimo e democrático de manter a candidatura. Acredito na justiça e as populações de Juazeiro e das cidades que nos apoiam podem ter certeza que irão eleger seu representante para a Câmara dos Deputados”, declarou Isaac Carvalho.
