O ministro do Supremo Tribunal Federal (STF) Alexandre de Moraes decidiu há pouco negar pedido de liberdade feito pela defesa do ex-presidente Luiz Inácio Lula da Silva. O ministro também rejeitou outro pedido para que o recurso seja julgado pela Segunda Turma da Corte, e não pelo plenário.
A defesa de Lula recorreu da decisão do relator do pedido de liberdade, ministro Edson Fachin, que, na sexta-feira (22), enviou pedido de liberdade ou prisão domiciliar do ex-presidente para julgamento pelo plenário, e não na turma, como queria a defesa.
No colegiado, há maioria de três votos a favor de mudar o entendimento que autoriza prisão após o fim dos recursos na segunda instância da Justiça. A turma é formada pelos ministros Gilmar Mendes, Dias Toffoli, Ricardo Lewandowski, além de Fachin e Celso de Mello.
Ao justificar o envio, Fachin disse que a questão deve ser tratada pela Corte por exigir análise do trecho da Lei da Ficha Limpa que prevê a suspensão da inelegibilidade “sempre que existir plausibilidade da pretensão recursal”.
Ontem (28), a defesa de Lula, em novo recurso ao próprio Fachin, afirmou que análise da questão não foi solicitada, e Fachin deve rever sua justificativa.
Lula foi condenado a 12 anos e 1 mês de prisão pelos crimes de corrupção e lavagem de dinheiro no caso do triplex em Guarujá (SP) e teve a pena executada pelo juiz federal Sergio Moro após o fim dos recursos na segunda instância da Justiça, conforme definiu o STF.
Com a confirmação da condenação na Operação Lava Jato, o ex-presidente foi enquadrado na Lei da Ficha Limpa, que impede a candidatura de condenados pelos órgãos colegiados da Justiça. No entanto, Lula ainda pode ser beneficiado por uma liminar e disputar as eleições.
