Quando a Lei 13.165/2015 foi sancionada , o prazo de uma ano para mudança de partido, foi trocado para seis meses antes das eleições . Essa brecha abriu a possibilidade para que os partidos escolham seus candidatos mais próximo do pleito.
Segundo reza o texto da Lei, todo final de mandato, seis meses antes da eleição, será aberta janela para livre troca de partido, sem perda do cargo, para os mandatos que estejam se findando no respectivo ano eleitoral. Em 2018, por exemplo, teremos essa janela da Lei 13.165 para senadores e deputados. O prazo final para usar a janela para trocar de partido vai atá o dia 7 de abril. A eleição de 2018 acontecerá no domingo, dia 7 de outubro.
O advogado José Rosa, especialista em eleições e Leis eleitorais, chama a atenção para que os filiados aptos a disputar cargos em 2018,usem a janela da Lei 13.165/2015, dias antes do limite para se registrar no partido, pois há período de impugnação e o trâmite de homologação.
“A data para filiação partidária daqueles que querem ser candidatos nas Eleições de 2018, o limite é o dia 7 de abril de 2018. Essa data deve ser observada com certa restrição. Porque a filiação deve estar homologada no dia 7. Portanto, a filiação deve ser feita uns 5 dias antes para dar prazo de impugnação e homologação”, argumenta o advogado.
Desincompatibilização
A desincompatibilização é instituto de direito eleitoral pelo qual a pessoa que pretende concorrer a mandato eletivo deve afastar-se de cargo, emprego ou função pública (direta ou indiretamente) de exercício atual para exercer plenamente seus direitos políticos, evitando, assim, a condição de inelegível.
Devem se desincompatibilizar, os servidores e empregados da Administração Pública Direta, Indireta e Fundacional do Poder Executivo que desejarem concorrer a cargo eletivo em eleições devem afastar-se do exercício de seu cargo, com vencimentos e vantagens integrais, da data do registro de sua candidatura pela Justiça Eleitoral, até o dia seguinte ao da eleição.
O não afastamento do empregado, do servidor público e/ou comissionado, do exercício de seu cargo ou função, poderá constituir caso de inelegibilidade, conforme previsto no art. 1° da Lei Complementar Federal n° 64, de 18 de maio de 1990.
