O Supremo Tribunal Federal julga nesta quarta-feira recurso que pode cancelar o ressarcimento de R$ 1 bilhão dentro da Lei de Improbidade Administrativa. A Corte vai analisar o pedido de dois prefeitos para serem enquadrados, por serem políticos, só no crime de responsabilidade, que prevê o impeachment, mas não a devolução dos recursos.
Se acatado, implicará em chefes de gabinete ressarcindo o erário e os prefeitos, não. Para Manoel Murrieta, da Associação dos Membros do Ministério Público (parte da ação), seria um “retrocesso gravíssimo no combate à corrupção”.
Outro risco diz respeito à prescrição. Na Lei de Improbidade, a punição é imprescritível quando a ação se inicia. Já o crime de responsabilidade prescreve em 10 anos.
O rombo. Só no Departamento de Patrimônio Público e Probidade da AGU são 3.215 ações envolvendo prefeitos que podem ser canceladas. A AGU argumenta que a punição por atos de improbidade não se confunde com a persecução criminal.
