O procurador-geral da República, Rodrigo Janot, enviou ao Supremo Tribunal Federal (STF) o pedido para prender o empresário e dono do grupo J&F, Joesley Batista, segundo apurou o jornal “O Estado de S. Paulo”. O pedido ainda precisa ser analisado pelo ministro Edson Fachin, relator da Lava Jato na Corte.
Segundo apurou o jornal, Janot também pediu a prisão do diretor do J&F, Ricardo Saud, e do ex-procurador Marcello Miller.
Em conversa entregue pela própria defesa da JBS, Saud e Joesley conversam sobre a suposta interferência de Miller para ajudar nas tratativas de delação premiada. O ex-procurador ainda fazia parte do Ministério Público quando começou a conversar com os executivos, no final de fevereiro. Ele foi exonerado da instituição apenas em abril.
Na segunda-feira, Janot abriu um procedimento de revisão do acordo de delação dos empresários. Ele vai pedir a revogação do benefício de imunidade penal concedido aos delatores.
A prisão preventiva já vinha sendo analisada por Janot nos últimos dias. Na quinta-feira, 7, os executivos prestaram esclarecimentos à PGR, mas não convenceram. A avaliação na instituição é de que o discurso era somente para manter a validade do acordo, mas os fatos narrados foram graves.
No caso de Miller, há auxiliares de Janot que avaliam que ele atuou junto à JBS com uso de informações privilegiadas que possui por ter integrado a equipe de Janot e pode ter incorrido no crime de obstrução de justiça e exploração de prestígio.
