OSupremo Tribunal Federal (STF) confirmou hoje (15) o entendimento que autorizou transexuais e transgêneros a alterarem o nome no registro civil sem a necessidade de cirurgia de mudança de sexo. Com a decisão, a alteração poderá ser feita por meio de decisão judicial ou diretamente no cartório.
Por unanimidade, a autorização já tinha sido dada no dia 1º de março deste ano, quando o Supremo julgou uma ação mais ampla sobre a questão. O caso voltou à pauta em função de outro processo que trata do tema e que ficou pendente de julgamento.
O caso concreto envolvia o recurso de uma transexual contra decisão da Justiça do Rio Grande do Sul, que negou autorização para que um cartório local aceitasse a inclusão do nome social como verdadeira identificação civil. Os magistrados entenderam que deve prevalecer o princípio da veracidade nos registros públicos.
Ao recorrer ao Supremo, a defesa do transexual alegou que a proibição de alteração do registro civil viola a Constituição, que garante a “promoção do bem de todos, sem preconceitos de sexo e quaisquer outras formas de discriminação”.
Antes da decisão do Supremo, transexuais somente podiam adotar o nome social em identificações não oficiais, como crachás, matrículas escolares e na inscrição do Exame Nacional do Ensino Médio (Enem), por exemplo.
